Terms & Conditions of Use of the Design My Samsonite Contest
“Design My Samsonite” is an international design Contest arranged by Samsonite Europe NV, hereafter “the Contest”. Participation is open to applicants from every European country (excluding Italy), as well as Russia, South Africa and Turkey, and who have obtained the legal age. The registration opens on January 15th, 2014 and the deadline is March 14th, 2014. Registration is free and applicants must accept the Contest terms and conditions. Please observe – in particular – the conditions applicable to the intellectual property rights to Contest entries and/or submissions.
The Contest is organized by Samsonite Europe NV, with registered office at Westerring 17, 9700 Oudenaarde, Belgium, hereafter “the Organizer”.
2. Entrant Criteria - Eligibility
Participation is open to applicants from every country in Europe (excluding Italy), as well as Russia, South Africa and Turkey and who have obtained the legal age, hereafter “the Participant(s)”.
The Organizer reserves the right to exclude without any justification Participants who do not meet the conditions of entry and/or submission to the Contest. Also excluded from the Contest are persons using prohibited aids or otherwise seeking to obtain advantage by manipulations of any kind whatsoever. In such cases, the Organizer reserves the right to disallow prizes. Employees (and their immediate family members) of the Organizer are not eligible for winning.
It is not the responsibility of the Organizer to ensure that the Contest entry and/or submission requirements and use of personal information do not contravene the laws and regulations of any country from which the entry and/or submission is being submitted, where it is being received or viewed. For the aforementioned reason, all responsibilities relating to the entries and/or submissions to the Contest will be borne by the Participants who, it is understood, have submitted such entries and/or submissions under their own responsibility and risk. In the event that any misfortune or damage should be experienced on the side of the Participant(s), the Organizer will not be responsible.
The Contest will begin on January 15th, 2014. All Participants submitting an entry must deliver finished work through the Design My Samsonite-website (http://www.designmysamsonite.com). All entries and/or submissions must be received by 11:59 pm ET on March 14th, 2014.
Each entry and/or submission will be screened before being shown in the online gallery and the Participants will receive confirmation of acceptance/rejection of the entry and/or submission.
Participants must submit a fully completed entry form.
The Contest objective is to design an artwork which can be printed on a Cosmolite suitcase. The winning design may be produced and sold as a limited edition.
Participants can go on the Contest website (www.designmysamsonite.com) to download the template for submitting their artwork. All submitted designs will be displayed in the online gallery on the Contest website after approval. The winners will be selected by a jury composed of six people from the Organizer’s Marketing and Design department.
5. Technical Requirements & Restrictions on Artwork Entries and/or submissions
The artwork should be based on one of the following themes: Europe, United Kingdom, France, Spain, Germany, Belgium, The Netherlands, Sweden, Denmark, Norway, Finland, Russia, Turkey and South Africa.
Artwork entries and/or submissions must be created on the provided template. Participants may enter up to three designs based on any of the above mentioned themes. The artwork will be printed on white suitcases. Please visit www.designmysamsonite.com to read the Contest dynamics, download the template and submit artworks. The artwork should be provided as a PDF-file in CMYK. Maximum file size is 2MB, format A4 with the picture of the suitcase and the graphics integrated on it (without the dotted line). The dotted line reflects the maximum printing area that can be used. The Organizer reserves the right to exclude any files which are not compatible. The design should not contain scandalous, libelous, or unlawful matter, logos or names of other brands. After selection of the winners, the winners will be contacted to deliver the selected designs in better resolution. A PDF, CMYK, 150 dpi, format scale 1, (H) 650 x (W) 422 mm, with the correct position of the graphics inside the printing area (dotted line).
6. The Jury & Prizes
The winners will be selected by a Jury composed of six people from the Organizer’s Marketing and Design department.
The following prizes can be won:
There will be one winner selected per theme, fourteen (14) in total. All of them will win a Cosmolite Spinner 55.
Out of the fourteen (14) winners mentioned above, there will be five (5) winners of the Grand prize.
City trip to a European city by choice including flight and lodging (travel voucher worth € 1.500)
The winning designs may be produced and sold in a limited edition. The Organizer reserves the right to decide on the produced quantities.
The travel vouchers in the amount of € 1.500 must be used no later than end 2015. The vouchers will be issued by a travel agency by choice of the Organizer. In countries using another currency than €, the exchange rate that will be used is the day rate of the ECB of the final day of the Contest (March 14, 2014).
Only one Grand Prize can be won per physical person
Related to the design with the most votes gathered on www.designmysamsonite.com.
1 set of Cosmolite suitcases (Cosmolite Spinner 55/20 Red and Cosmolite Spinner 74/27 Red).
The winners will be selected and informed on March 21st, 2014, but the date can be delayed due to unexpected circumstances. A copy of the identity card of the winners may be requested. After confirmation of the price, the winners will be announced on www.designmysamsonite.com and the Samsonite Facebook-page (www.facebook.com/samsoniteofficial).
The travel vouchers and the suitcases will be sent to the winners via courier.
ALL submissions (not just winners) will be displayed on the Design My Samsonite-website gallery, Samsonite Facebook-page and Samsonite Pinterest-page.
Notification: Potential winners will be notified by email and must respond to accept or decline the prize within ten (10) calendar days of notification. If a potential winner cannot be contacted, does not timely respond or if prize or prize notification is returned as undeliverable, an alternate potential winner will be selected. Upon prize forfeiture, no payment or other compensation will be made to the original potential winner. Where a winner does not qualify or respond, the next recipient will be notified and will receive an opportunity to qualify. In the event of non-compliance with this or any other requirement, the non-complying potential winner will be disqualified. The decision of the jury is final.
No cash substitution will be allowed. Each prize is awarded “as is”, without warranty regarding the underlying services of performance. The Organizer is not responsible for direct or indirect damages that occur as the result of the use or loss of the prize, regardless of cause.
If the prizes cannot be awarded due to circumstances beyond the reasonable control of the Organizer, it will at its sole discretion reserve the right to substitute with a prize of equal value.
The Organizer will not discuss, respond to or comment on any queries or comments regarding the Contest results. The decisions of the Organizer will be final and unquestionable.
7. Responsibility and Disclaimers
At the time of entry and/or submission, Participants are deemed to have read, understood and be in agreement with the Terms and Conditions of the Contest. If they do not agree with them, they should not proceed with the Contest. By continuing to participate in this Contest, they agree to be bound by these Terms and Conditions.
The Organizer shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate entries and/or submissions, (ii) computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays; (iii) data corruption, destruction, unauthorized access to or alteration of entry and/or submission or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of the prizes, or from participation in this Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with this Contest.
The Organizer disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserves the right, in its sole discretion, to cancel, modify or suspend this Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond the Organizer’s control, corrupt the administration, security or proper play of this Contest.
By participating in this Contest, Participants agree that no claim shall be asserted against the Organizer, its affiliates or any of its respective directors, officers, employees or agents in respect of any damages, rights, claims or actions of any kind whatsoever that result from their participation to this Contest and/or acceptance and enjoyment of the prizes.
The Contest is void where prohibited. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any Participant expressly waives any and all such rights.
8. Intellectual Property
Contest entries and/or submissions will not be returned to Participants, unless agreed otherwise in writing.
In respect of copyright and other intellectual property rights in entries and/or submissions into the Contest, and in any and all artworks and other details submitted, and in the Participants involvement in the Contest (including, without limitation, all interviews, pictures, audio, audio-visual, whether the Participants appearance is featured or incidental), in all media and technology, (hereafter the “Works”) the Participants:
(a) hereby grant to the Organizer and any affiliate of the Organizer, a non-exclusive, royalty-free perpetual worldwide licence to use any such copyright and other intellectual property rights in any media and in any form to the extent the Organizer deems it appropriate; and
(b) agree, at the Organizer's request, to assign to the Organizer, the entire such copyright and other intellectual property rights, and agree to do all such acts as may be reasonably requested by the Organizer to effect the assignment under this clause
and the Participants agree that the licence and, if applicable, any assignment shall include the right for the Organizer to alter, edit, compile, amend or otherwise adapt such Works and/or use such Works in conjunction with any other material and to use, distribute and/or broadcast such Works in all media and all formats and the right to sub-license such rights to any other persons, in each case for such purposes as the Organizer may in its absolute discretion determine.
Participants represent and warrant that the Contest entry and/or submission and Works are his/her own creation and that the Works do not include nor infringe any third party intellectual property rights, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening, and that the Organizer is free and able to use the Works and artworks.
Participants agree to waive any moral rights in the Works and represent and warrant that they have obtained a waiver of all applicable moral rights in the Works and further have obtained all consents and permissions in respect of the Works if applicable.
Participants must ensure, and represent and warrant that any person or persons whose image has been used in the relevant Works has given consent for the use of their image or has waived any rights they may have in the images, videos or other media submitted. Failure to adequately demonstrate this consent to the satisfaction of the Organizer may result in your disqualification from the Contest and forfeiture of any Prize.
Each entry and/or submission becomes part of the public online contest catalogue.
9. Publicity and Promotion
Design My Samsonite is an international design contest receiving media interest. By entering the Contest, the Participant understands that the submission material is made publicly available and will be able to be shared by the Participants, general public across any and all media channels and the Internet.
The winning designs may also be used for commercial purposes and may be communicated on fairs, in the Samsonite Dealer Catalogue September 2014, on Samsonite e-commerce websites, Samsonite contest minisite and in the shops.
Any Participant to the Contest may be asked to take part in publicity and promotional activities for Design My Samsonite. By entering the Contest, the Participant is accepting that his name, concept descriptions, project details, images and footage can be used for publicity purposes. The Participant may be asked to take part in interviews.
10. No Reimbursement or Employment
Participants are not entitled to any compensation or reimbursement for any costs. The participation shall not constitute employment, assignment or offer of employment or assignment.
11. Use of the Applicant’s Personal Data
The Organizer will use the personal data you submit in connection with the Contest for the purpose of administering the Contest and evaluating the Works. Any questions with regard to the use of personal data or to amend personal data, should be directed to: email@example.com.
12. Commercial Authorisation
By taking part in the Contest, the Participants authorize the Organizer to use their surname, forename, photo and Work for any commercial purposes.
By entering the Contest Participants agree to abide by all rules.
14. Miscellaneous Provisions
Legal relationship between the Organizer and the Participants is governed by the applicable laws of Belgium. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction in Belgium.
When collecting and processing personal data, the Organizer is subject to the data protection laws of the jurisdiction of the Organizer.
However, if you communicate with the Organizer with regard to any and all legal actions or claims arising in connection with this Contest by email, Participants should note that the security of Internet email is uncertain. By sending sensitive or confidential email messages that are not encrypted, you accept the risks of such uncertainty and possible lack of confidentiality over the Internet.
The Organizer reserves the right to amend these Terms and Conditions at any time without prior notice.
